1. About these terms

By installing the webQsee browser extension, or by accessing webqsee.com, view.webqsee.com or app.webqsee.com, you accept these Terms of Use and our Privacy Policy. If you do not accept them, please do not install the extension or use the services.

2. The webQsee license

Subject to your compliance with these terms, pagu.at grants you a non-exclusive, non-transferable, revocable right to use the webQsee extension and associated services for personal or business use, within the published feature limits of your plan.

You may use webQsee inside your organisation provided each individual user agrees to these terms. The license does not allow you to:

• Resell, sublicense or otherwise make webQsee available to third parties as a standalone service.
• Remove or alter copyright, trademark or other proprietary notices.
• Use webQsee's branding to imply endorsement of your product or company.

3. Account & credentials

You are responsible for keeping your account credentials secure and for everything that happens under your account. If you suspect that your credentials have been compromised, notify us immediately at support@webqsee.com so we can help lock down the account.

pagu.at may suspend or terminate accounts engaged in abusive, fraudulent or illegal activity, for example, automated scraping, attempts to circumvent plan limits, or use that endangers the security of other users. Where reasonably possible we'll warn you first; we reserve the right to act immediately for severe violations.

4. Plans, pricing & payment

Current plans and pricing are published at /pricing.html. Prices may change; for existing subscribers, any price increase will be announced at least 30 days before the next renewal and you can cancel before then.

Unless stated otherwise:

• Subscriptions are annual and renew automatically on the anniversary of purchase.
• You can cancel any time from your account settings, cancellation takes effect at the end of the current billing period; the service stays active until then.
• Payments are processed by Braintree (PayPal Inc.). Invoices are issued by pagu.at, including Austrian VAT where applicable.

5. Acceptable use

When you use webQsee, you agree not to:

• Reverse-engineer the extension or services beyond what local mandatory law explicitly permits (e.g. Austrian §40d UrhG for interoperability).
• Circumvent rate limits, feature gates, or any other plan boundary.
• Use webQsee to capture data that you do not have a legal right to capture, for example, recording other people's traffic without their consent, harvesting personal data in violation of GDPR, or capturing material protected by trade-secret or confidentiality obligations you have not been released from.
• Interfere with the integrity or performance of the service, including via denial-of-service attacks or attempts to obtain unauthorised access.
• Use webQsee for any illegal purpose under Austrian, EU or your local law.

6. Cloud storage data

When you connect Cloud Gallery to your own Amazon S3 (or S3-compatible) bucket, any captures uploaded there remain entirely yours. You are the controller of that data under GDPR; webQsee is not. We have no access to your bucket's contents, the captures flow browser-to-bucket using credentials you control.

For the gallery metadata you choose to store on webQsee servers (titles, descriptions, status, tags, shared-with lists), webQsee acts as a processor on your behalf. A Data Processing Agreement under Art. 28 GDPR is incorporated by reference and available on request at privacy@webqsee.com.

7. Service level / availability

We target 99.5% monthly availability of the metadata API at app.webqsee.com. Planned maintenance will be announced at least 48 hours in advance when feasible.

An important property of webQsee: the extension itself runs offline-first. Capture, replay and analysis of locally stored sessions are unaffected by any outage of our API. If the metadata API is down you can keep working, only cloud sync and team features pause until it's back.

8. Disclaimers

To the maximum extent permitted by applicable law, the webQsee service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that webQsee will be free of bugs, that captures will be free of personal information, or that every browser update will leave every feature working identically. You are responsible for redacting sensitive data before sharing a capture with anyone, webQsee gives you the tools, you decide what goes out.

9. Limitation of liability

To the maximum extent permitted by Austrian law, pagu.at's total liability under or in connection with these terms is capped at the fees you paid us during the twelve months preceding the event giving rise to the claim. For free-tier users this cap is the statutory minimum.

This cap does not apply to:

• Damages caused by gross negligence or intent on our part.
• Liability for personal injury or death.
• Any liability that cannot be excluded under mandatory Austrian or EU consumer law.

We are not liable for indirect, incidental, special, consequential or punitive damages (lost profits, lost data, business interruption) except where Austrian law makes such exclusion ineffective.

10. Indemnification

You agree to indemnify and hold pagu.at harmless from any third-party claim, liability, damage or expense (including reasonable legal fees) arising out of your misuse of the service or the content you process through it, for example, claims by people whose data you captured without authority, or claims relating to material you uploaded to your S3 bucket in violation of someone else's rights.

11. Termination

You may stop using webQsee at any time. You can uninstall the extension and delete your account from your account settings, local captures stay in your browser until you remove the extension.

We may terminate accounts that materially violate these terms. We will give at least 30 days' notice before terminating an account, except in cases of severe or repeated violations (for example, criminal activity, fraud, or use that endangers other users), in which case termination may be immediate.

12. Modifications

We may update these terms from time to time. For material changes, anything that changes your rights or obligations in a meaningful way, we'll email registered users at least 30 days before the change takes effect, so you have time to review and, if you disagree, terminate your subscription. Continued use of the service after the effective date constitutes acceptance.

13. Governing law & jurisdiction

These terms are governed by the laws of Austria, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For disputes arising out of these terms, the courts of Linz, Austria shall have exclusive jurisdiction, without prejudice to any mandatory consumer-law protection that grants a consumer the right to sue, or be sued, in the courts of their place of residence.

14. Online dispute resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration body, and we generally prefer to resolve issues directly, please reach out to support@webqsee.com first.
